What's Going On with the Upcoming November Hemp Ban?
All eyes in the beverage industry right now are on one date: November 12, 2026. That's when new federal legislation replacing the 2018 Farm Bill is set to take effect. It redefines hemp and caps total THC at 0.4mg per container, nationwide.
Lawmakers still have a few paths open:
- Let the ban take effect as written
- Push the deadline back a month, to December 11, 2026
- Replace it with real regulation
Where we stand
We support common sense laws and regulation. What we're against is a ban dressed up as safety, and a THC mg cap so low it functions as prohibition. Those measures don't make anyone safer. They just close small businesses and take away a choice adults have already made for themselves.
Whatever happens, we're not disappearing. We believe in this industry, we believe in this product, and we believe in hemp. If we were betting people, we'd put our money on a last-minute regulatory measure passing, most likely in October, that regulates hemp nationally the same way alcohol already is. But only time will tell.
In the meantime, The Health Club will keep operating as usual: still producing the seltzers you know and love, and staying transparent with you on any legal or regulatory updates as they come. We're here till the wheels fall off.
What you can actually do about it
Lawmakers listen to real voters in their own districts. The window to be heard is now.
- Contact your reps: Hemp Industry Farmers of America (HIFA) is a major player in working to keep hemp legal and have a one-click, pre-written letter straight to your representatives.
- Support the brands you love and stock up: If there are flavors you've been meaning to try, now's the time. While other brands may be scaling back production, we're doing everything we can to keep your favorite products in stock right up until the last day.
