SB250 Passed (with Amendment)
On Wednesday February 18th, Indiana House Committee on Courts and Criminal Code voted to pass SB250 with a significant new amendment.
Notable changes in the proposed amendment include:
Strict THC Limits - Hemp products in Indiana may no longer exceed a combined total of 0.4 milligrams of THC per container.
Manufacturing Restrictions - Manufacturers in business before January 1, 2026, may continue operations, but only for distribution outside of Indiana.
Timeline - The effective date is set to mirror the proposed federal hemp ban on November 12, 2026.
Permitted Cannabinoids - While "CBD and CBG" remain allowed, further clarification is needed regarding the legality of full-spectrum CBD.
What This Means for Customers and Retailers
SB250 and its amendments would fundamentally change which THC products remain on shelves in Indiana. For Hoosier customers, this effectively ends access to most hemp-derived THC products currently sold legally. Retailers would be forced to pull these products from Indiana shelves by November 12th of this year.
Additionally, products currently manufactured legally within the state could still be produced in Indiana, but they could no longer be sold to Indiana residents. These changes signal a total shift in the landscape, restricting access for the thousands of Hoosiers who rely on regulated hemp-derived products.
Next Steps
Now that SB250 has passed the Committee vote, it moves to a Full House Vote, with 51 votes needed to pass. If it passes there, it will head to Governor Braun’s desk for a final signature (or a potential veto).
